2. Service Description
Heard provides AI-powered emotional support through phone conversations. Our service includes:
- A 15-minute phone call with an AI companion.
- The call will begin immediately after successful payment.
- The service is provided on a per-call basis.
3. User Eligibility
To use our service, you must:
- Be at least 18 years old
- Have a valid phone number
- Have the ability to make payments
- Agree to these terms and conditions
4. Payment Terms
4.1 Pricing
- Each call costs $2
- Payment is processed securely through Stripe
- All fees are non-refundable unless otherwise stated
4.2 Billing
- Payment is required before each call
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in service suspension
5. User Responsibilities
You agree to:
- Provide accurate and complete information
- Use the service for its intended purpose only
- Not attempt to record or store conversations
- Not use the service for illegal or harmful purposes
- Not attempt to manipulate or abuse the AI system
- Respect the 5-minute call duration limit
6. Prohibited Uses
You may not use our service to:
- Harass, threaten, or harm others
- Engage in illegal activities
- Attempt to gain unauthorized access to our systems
- Use automated tools to access the service
- Share inappropriate or offensive content
- Attempt to reverse engineer our technology
7. Service Availability
While we strive for 24/7 availability, we do not guarantee uninterrupted service. We may:
- Perform maintenance that temporarily affects service
- Limit access during high usage periods
- Suspend service for security or technical reasons
8. Privacy and Data
Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these terms by reference. We do not:
- Record or store audio conversations
- Share your personal information with third parties
- Use your data for purposes other than providing our service
9. Intellectual Property
All content, features, and functionality of our service are owned by Heard and are protected by copyright, trademark, and other intellectual property laws.
10. Disclaimer of Warranties & Limitation of Liability
Heard is not a substitute for professional medical advice, diagnosis, or treatment. Our service provides emotional support only and should not be used for:
- Medical or psychiatric emergencies.
- Diagnosing medical conditions.
- Crisis situations (e.g., thoughts of self-harm).
If you are in a crisis, please call 911 or a crisis hotline immediately.
To the maximum extent permitted by law, Heard shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
11. Indemnification
You agree to indemnify and hold harmless Heard from any claims, damages, or expenses arising from your use of the service or violation of these terms.
